Terms and Conditions

Program Overview

The Fuel Your Fenix Reward Program (“Program”) is sponsored by Organo Gold Int’l, Inc. (“ORGANO “). It is intended to encourage and motivate participants enrolled in the XChallenge to continue maintain their healthy and active life style. This program is an addition to the reward program already in place for XChallenge participants and does not affect that program’s quarterly and annual rewards. With this Program, ORGANO intends to provide additional supports to empower all XChallenge participants to reach their ultimate goal of losing weight.

Qualifying Participants

NO PURCHASE NECESSARY. This Program applies automatically to all participants who: (i) joined XChallenge before or during the period of July 1, 2018 to August 31, 2018 (“Reward Period”); (ii) logs his or her weekly weight and progress entry (“Testimonial”) on ORGANO’s website at least once; and, (iii) are residents of the United States of America or Canada, excluding Quebec (“Qualified Participants”). There is no need to separately sign up to this Program.

Rewards

At or about the end of each month during the Reward Period (July, and August), ORGANO will reward three (3) randomly selected Qualified Participants with ORGANO weight management kits: one (1) ultimate kit (1 OGX FENIX Creamy Vanilla + 1 OGX FENIX Rich Chocolate + 1 Gourmet Black Coffee + 1 Organic Green Tea + 2 x FENIX XT + 2 x FENIX DX + 1 Ganoderma Lucidum; approximate retail value US$425.50/CA$526.75), one (1) advanced kit (1 OGX FENIX Creamy Vanilla + 1 OGX FENIX Rich Chocolate + 1 Gourmet Black Coffee + 1 Organic Green Tea + 2 x FENIX XT + 1 x FENIX DX; approximate retail value US$322/CA$407.50), and one (1) breakfast kit (1 OGX FENIX Creamy Vanilla + 1 Gourmet Black Coffee + 1 x FENIX XT; with approximate retail value US$137/CA$173.50) (“Monthly Rewards”).

Each Qualifying Participant will receive one draw ticket for each Testimonial logged in a given month to participate in the monthly draw. Recipient of the Monthly Rewards will be selected by drawing random ticket from all the Qualifying Participants in a given month.

The Recipients will be informed about the selection by personal email (“Email Notification”) and announced on ORGANO’s website and Facebook/Instagram accounts.

Recipients can refuse acceptance of the rewards by a reply to the Email Notification.

Privacy Policy

Information collected from Qualified Participants is subject to ORGANO’s privacy policy, located at <https://www.organogold.com/en/privacy-policy>.

General Terms

These Terms and Conditions are void where and to the extent prohibited by law.

Qualified Participants are responsible for any tax liability resulting from receiving the rewards in the Program.

Except where prohibited, Qualified Participants agree that any and all disputes, claims and causes of action arising out of or connected with this Program shall be resolved exclusively by arbitration, and any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred by Qualified Participants with regard to this Program, and in no event include attorneys’ fees, punitive, incidental, consequential or other damages.

All issues and question concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of the Qualified Participants and ORGANO in connection with the Program shall be governed by and construed in accordance with the laws valid and applicable within the Province of British Columbia without reference to any rules or other provisions regarding the conflict of laws; and, the Qualified Participants and ORGANO hereby consent to attorn to the respective authority of the venues of first instance contemplated by the laws applicable within the Province of British Columbia.

ORGANO reserves the right to modify, suspend or terminate the Program without notice by posting a notice on ORGANO’s website, in its sole and absolute discretion.
